Terms of Service

1. Acceptance of terms

By applying for, engaging, or using the services of YourFreeWebsite.ca ("we", "the Service"), you confirm that you have read, understood, and agreed to these Terms of Service. If you do not agree, you must not use the Service.

2. Description of the service

We design and build a custom, professional website for your business at no upfront build cost. The service is sustained by a flat monthly hosting and maintenance retainer, quoted clearly before any work begins. The retainer covers dedicated server resources, SSL renewal, daily backups, security patching, uptime monitoring, and technical support.

3. Application and eligibility

We accept a limited number of projects per month and reserve the right to approve or decline any application at our discretion. We do not build sites for adult content, gambling, payday lending, or any activity that violates Canadian law.

4. Retainer and payments

The monthly retainer is flat and disclosed before you commit. We will not raise the rate without at least 60 days written notice. Non-payment may result in suspension of the service following appropriate notice.

5. Domain and content ownership

You own and will continue to own your domain name and all content you provide or create (text, images, logo). We will never register your domain in our name. We retain rights to the underlying codebase and reusable components we develop.

6. Editor and administrative access

You receive Editor-level access to the content management system to update your site. We retain administrative server privileges to protect the availability and security of the infrastructure. Full administrative access is available upon written request.

7. Cancellation and portability

You may cancel at any time with 30 days written notice. On cancellation we provide a full export of your website files and database so you can migrate to another provider. There are no exit penalties.

8. Additional work

Advanced features (e-commerce, integrations, booking systems, etc.) are billed at a transparent hourly rate, quoted and approved before work begins.

9. Limitation of liability

The Service is provided "as is". To the maximum extent permitted by law, we are not liable for indirect damages, lost profits, or data loss. We maintain daily backups, but we recommend you keep copies of your original content.

10. Changes

We may update these terms. We will post the current version on this page with its update date. Continued use of the Service constitutes acceptance of the changes.

11. Governing law

These terms are governed by the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any dispute will be submitted to the competent courts of Toronto, Ontario.
